Unauthorised Foreigners Who Complete Vocational Training To Be Granted Residency In Spain Spain News

Foreigners without legal residency in Spain who complete vocational training courses will be granted a temporary residence permit, the Spanish government has announced.

The Education Ministry is devising a potential resolution for the nearly 500,000 undocumented migrants in the country by proposing a temporary residency offer to those who undertake vocational training, commonly referred to as "Formación Profesional (FP)" in Spanish.

To take advantage of the Spanish government's offer, non-resident foreigners must fulfill specific prerequisites such as possessing adequate Spanish proficiency and relevant skills that enable them to complete their preferred vocational training.

Included in the first draft of the royal decree on the Regulation of Vocational Training, which was originally sanctioned in 2022, this initiative, if approved by the Congress and Senate of Spain, will reinforce the rights, freedoms, and social integration of non-native residents in Spain.

Due to not being able to obtain residency permits, hundreds of thousands of undocumented foreigners in Spain are compelled to work in the black economy and as a result, are susceptible to exploitation. They are unable to take advantage of the country's labor laws, and social security system, as well as education and training opportunities.

This measure will establish and standardise the recently introduced "settlement through training" (arraigo por formación) temporary residency authorization, which was introduced in August. It is intended for individuals from non-EU countries who have resided in Spain for at least two years and are interested in pursuing vocational training.

However, being granted residency will be dependent on the person passing their corresponding course.

The Ministry of Education has confirmed that the courses will be shorter, however, will give the candidates sufficient qualifications to allow them to access the labour market quickly.

The opportunities will also be made available to everyone and not just to younger people.

The temporary permit will remain valid for the duration of the course but if the student receives a job offer at the end, they will be permitted to apply for a two-year residency in Spain.

Prior to recent changes, non-EU foreigners seeking employment in Spain had to either apply for a position listed in the skills shortage registry or the employer had to demonstrate that no EU applicant was qualified for the job.

In response to significant labor shortages, the Spanish government revised its regulations in 2022 to enable Spanish employers to hire non-EU candidates for all categories of blue-collar work, ranging from positions that are considered highly skilled to low-skilled roles.
